When a divorce is settled, child support, child custody and visitation, and alimony orders are finalized by the court. From that point forward, both parties are legally obligated to follow the agreement approved by the court.

Unfortunately, that legal obligation does not always translate into a check arriving in the mail in a timely fashion. Types of Enforcement Action

There are a variety of actions that may be taken against a party who is not living up to the terms of a court order. Depending upon the type of order that has been violated, these may include:

  • Garnishing wages (having money taken directly from a paycheck) in cases of child support enforcement
  • Seizing assets in a bank account
  • Notifying police and having the person arrested and jailed
  • Loss of drivers' license until arrearages are paid

Visitation: Your child custody order states that you can take your child on vacation as long as you give notice to the other parent, but the other parent says you never called or emailed.
