Post-Nuptial Agreements

A post-nuptial agreement is very similar to a premarital agreement, but it is created after the marriage. A couple may enter into a post-marital agreement if they forgot to include some assets in their initial premarital order, or if circumstances changed and the parties wished to formalize their preferences regarding those changes. For example:

  • If one partner owned a business prior to the marriage and wished to ensure the business and it's growth was inherited by family members rather than an uninvolved second spouse.
  • If a partner was starting a new and risky business venture and the other spouse wished to be protect the home or his/her share of assets
